1. Acceptance of these terms

These Terms of Service (“Terms”) govern your use of the Mt Atkinson Coffee website and online store (“we”, “us”, “our”), and any order you place with us. By browsing our site or placing an order, you agree to these Terms. If you don’t agree with them, please don’t use the site or place an order.

These Terms should be read alongside our Privacy Policy, which explains how we collect and use your personal information, including through the third-party apps we use to run our store.

2. Who we are

Mt Atkinson Coffee is a  coffee roastery and coffee shop  based at 44b Portage Road, New Lynn, Auckland, New Zealand. You can reach us at digital@mtatkinson.co.nz for any questions about these Terms, an order, or our site.

3. Using our website

You agree to use our website only for lawful purposes, and not in a way that infringes anyone else’s rights or restricts anyone else’s use of the site. In particular, you must not:

●      Attempt to gain unauthorised access to our systems, accounts, or data

●      Use the site to transmit anything unlawful, defamatory, or harmful

●      Copy, scrape, or reproduce site content for commercial use without our permission

●      Interfere with the security or normal operation of the site

We may suspend or terminate your access to the site if we reasonably believe you’ve breached these Terms.

4. Orders and pricing

All prices on our site are listed in New Zealand dollars (NZD) and include GST unless stated otherwise. We take reasonable care to ensure prices and product descriptions are accurate, but errors can occasionally occur  if we find a pricing or listing error on an order you’ve placed, we’ll contact you before proceeding, and you’ll have the option to confirm the order at the correct price or cancel it for a full refund.

Placing an order through our checkout is an offer to purchase, which we may accept or decline (for example, if stock runs out or we suspect fraudulent activity). A contract is only formed once we confirm your order.

We may change, discontinue, or update products, pricing, and promotions at any time without notice.

5. Payment

Payment is processed securely through Shopify’s payment infrastructure. We don’t store your full card details ourselves. See our Privacy Policy for how payment information is handled by our payment providers.

6. Subscriptions

If you sign up for a recurring subscription order, it is processed through ReCharge, our subscription billing provider. By subscribing, you authorise us to charge your nominated payment method on a recurring basis according to the frequency you select.

You can manage, pause, skip, or cancel your subscription at any time through the customer portal link provided in your subscription confirmation email, or by contacting us directly. Cancelling a subscription stops future charges but doesn’t refund payments already processed for orders already dispatched.

7. Shipping and delivery

We aim to dispatch and deliver orders within the 1-3 days, but these are estimates only and not guaranteed delivery dates. Risk in the products passes to you once they’re delivered to the address you provided. If a delivery is delayed, lost, or damaged in transit, please contact us and we’ll do our best to resolve it.

8. Returns, refunds, and your consumer rights

Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. If a product is faulty, not as described, or doesn’t do what we said it would, you’re entitled to a remedy under that Act  which may include a repair, replacement, or refund depending on the circumstances.

For change-of-mind returns (where a product isn’t faulty), please contact us within 3 days of delivery  we’ll let you know whether a return, exchange, or store credit is available for that order. Coffee that has been opened generally can’t be returned for hygiene reasons, unless it's faulty.

9. Product reviews and user content

We use Judge.me to collect and display product reviews. If you submit a review, rating, or photo, you’re granting us permission to display it publicly on our store and in related marketing. Please make sure anything you submit is honest, doesn’t infringe anyone else’s rights, and isn’t offensive or unlawful. We may remove content that breaches this.

10. Intellectual property

All content on our site  including our brand name, logo, photography, copy, and design  is owned by Mt Atkinson Coffee or licensed to us, and is protected by New Zealand intellectual property law. You may view and download content for personal, non-commercial use only. You may not reproduce, distribute, or use our content commercially without our written permission.

11. Third-party services and links

Our store uses third-party apps, including Klaviyo, ReCharge, Judge.me, and Monster Cart, to operate certain features — see our Privacy Policy for details on what each does. Our site may also link to third-party websites. We don’t control and aren’t responsible for the content, terms, or practices of any third-party site or service.

12. Disclaimer and limitation of liability

To the maximum extent permitted by law, we exclude all warranties and conditions not expressly stated in these Terms or guaranteed under the Consumer Guarantees Act 1993 or Fair Trading Act 1986. Where you’re acquiring products or services for the purposes of a business, the Consumer Guarantees Act does not apply, to the extent permitted by law.

To the maximum extent permitted by law, we won’t be liable for any indirect, incidental, or consequential loss arising from your use of our site or products, except where that liability can’t lawfully be excluded.

13. Privacy

Our Privacy Policy explains how we collect, use, and disclose your personal information, including through the third-party apps we use. It forms part of these Terms by reference.

14. Changes to these terms

We may update these Terms from time to time to reflect changes to our business, our legal obligations, or the apps and services we use. Changes take effect once posted on this page. Your continued use of the site after an update means you accept the revised Terms.

15. Governing law and jurisdiction

These Terms are governed by the laws of New Zealand, and any dispute arising from them will be subject to the exclusive jurisdiction of the New Zealand courts.
